Terms and Conditions for Fresh Keeper

These Terms and Conditions (“Terms”) govern your use of the Fresh Keeper mobile application (“App,” “Application,” or “Service”) for mobile devices, created and operated by Mobile Craft (“we,” “us,” “our,” or “Service Provider”), a company operating from Nagpur, India.
By downloading, installing, accessing, or using the Fresh Keeper App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
1. Acceptance of Terms
By creating an account and using Fresh Keeper, you acknowledge that:
- You have read, understood, and agree to be bound by these Terms
- You have read and agree to our Privacy Policy
- You are at least 13 years of age
- You have the legal capacity to enter into a binding agreement
- All information you provide is accurate and truthful
2. Description of Service
Fresh Keeper is a mobile application that helps users:
- Track food and product inventory with expiry dates
- Receive notifications about expiring products
- Add optional product prices to track spending
- Mark products as used or wasted
- Generate wastage reports (Premium feature)
- Create shopping lists based on expired or used products (Premium feature)
- Export inventory and wastage data (Premium feature)
- Participate in a referral program to earn premium access
The App is available in both Free and Premium versions, with certain features requiring a Premium subscription.
3. Account Registration and Security
3.1 Account Creation
- You must create an account using a valid email address or Google Sign-In
- You are responsible for maintaining the confidentiality of your account credentials
- You must not share your account with others or allow others to access your account
- You are responsible for all activities that occur under your account
- You agree to provide accurate, current, and complete information during registration
- You agree to update your information to keep it accurate and current
- We reserve the right to suspend or terminate accounts with false or misleading information
3.3 Account Security
- You must notify us immediately at freshkeeperhelp@gmail.com if you suspect unauthorized access to your account
- We are not liable for any loss or damage arising from unauthorized use of your account
- You are solely responsible for securing your device and preventing unauthorized access
4. Premium Subscription
4.1 Premium Features
Premium subscribers gain access to:
- Shopping list creation based on expired or used products
- Product wastage tracking and marking
- Detailed wastage reports and analytics
- Data export functionality (CSV or other formats)
4.2 Pricing and Payment
- Monthly Subscription: ₹99 per month
- Annual Subscription: ₹599 per year (equivalent to ₹49.92 per month)
- All prices are in Indian Rupees (INR) and include applicable taxes
- Payments are processed securely through Google Play Billing
- By subscribing, you authorize Google to charge your payment method on a recurring basis
- All billing, refunds, and subscription management are handled by Google Play
4.3 Free Trial Through Referrals
- Users can earn Premium access by referring new users
- Each successful referral grants 7 days of Premium access
- A referral is considered “successful” when the referred user signs up and adds at least one product to their inventory
- Maximum Premium access through referrals: 90 days total
- Referral-earned Premium days are cumulative and automatically applied to your account
- Referral rewards cannot be transferred or exchanged for cash
4.4 Billing and Renewal
- Subscriptions automatically renew at the end of each billing period unless cancelled
- You will be charged at the start of each billing period
- Subscription fees are non-refundable except as required by applicable law
- We reserve the right to change subscription prices with 30 days’ notice to existing subscribers
- Price changes will not affect your current subscription period; new prices apply upon renewal
4.5 Cancellation
- You may cancel your subscription at any time through the Google Play Store
- Open Google Play Store app
- Go to Menu → Subscriptions → Fresh Keeper Premium
- Select Cancel Subscription
- You can also manage subscriptions at https://play.google.com/store/account/subscriptions
- Cancellation takes effect at the end of your current billing period
- You will retain Premium access until the end of your paid period
- No refunds or credits will be provided for partial subscription periods
- Cancelling a subscription does not delete your account or data
- For billing issues, contact Google Play Support
4.6 Refund Policy
- All subscription fees are non-refundable as per Google Play’s refund policy
- Refund requests must be made within 48 hours of purchase through Google Play Store
- To request a refund:
- Visit https://play.google.com/store/account/subscriptions
- Select Fresh Keeper Premium
- Click “Request a refund” (available for 48 hours after purchase)
- Refunds after 48 hours are at Google’s discretion
- We do not provide refunds or credits for partial months or years of service
- No refunds are provided if your account is suspended or terminated for violation of these Terms
- If you believe you were incorrectly charged, contact Google Play Support first, then contact us at freshkeeperhelp@gmail.com
- For billing disputes, Google Play’s payment policies and terms apply
5. Referral Program
5.1 How It Works
- Each user receives a unique referral code
- Share your referral code with friends and family
- When a new user signs up using your code and adds their first product, you earn 7 days of Premium access
- Referred users must be new to Fresh Keeper (no previous accounts)
5.2 Referral Limits and Rules
- Maximum 90 days of Premium access can be earned through referrals
- Referral days are added to your account automatically upon successful referral completion
- Referral-earned Premium access cannot be combined with paid subscriptions (paid subscriptions take priority)
- Referral rewards are personal and non-transferable
5.3 Referral Leaderboard
- Your referral count and username/referral code may be displayed on a public leaderboard
- The leaderboard shows only your referral count and username, not personal information
- Participation in the leaderboard is automatic for all users
5.4 Referral Fraud
- Creating fake accounts or using automated systems to generate referrals is strictly prohibited
- Manipulating the referral system in any way violates these Terms
- We reserve the right to revoke referral rewards and terminate accounts engaging in referral fraud
- Suspected fraud will be investigated, and appropriate action will be taken
6. User Responsibilities and Conduct
6.1 Acceptable Use
You agree to use Fresh Keeper only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Use the App in any way that violates applicable laws or regulations
- Create multiple accounts to abuse the referral program
- Share your account credentials with others
- Attempt to gain unauthorized access to other users’ accounts or our systems
- Upload or transmit viruses, malware, or any other malicious code
- Interfere with or disrupt the App’s functionality or servers
- Use automated systems, bots, or scripts to access the App
- Reverse engineer, decompile, or disassemble the App
- Remove, modify, or obscure any copyright, trademark, or other proprietary notices
- Use the App for any commercial purpose without our written permission
- Harass, abuse, or harm other users in any way
- Attempt to exploit bugs or vulnerabilities for personal gain
- You are responsible for the accuracy of all product information you enter (names, expiry dates, prices)
- Fresh Keeper is a tracking tool; we do not verify the accuracy of your product data
- Always verify product expiry dates on the actual product packaging before consumption
6.3 Internet Connection
- Fresh Keeper requires an active internet connection (Wi-Fi or mobile data) to function properly
- You are responsible for any data charges incurred from your mobile network provider
- We are not responsible if the App does not function due to lack of internet connectivity
6.4 Device Security
- You are responsible for maintaining the security of your device
- We strongly advise against jailbreaking (iOS) or rooting (Android) your device, as this may:
- Expose your device to malware and security vulnerabilities
- Compromise the App’s functionality
- Void any warranties or support from us
7. Content Ownership and License
7.1 Your Content
- You retain ownership of all data you create in the App (product inventory, shopping lists, notes, etc.)
- By using Fresh Keeper, you grant us a limited, non-exclusive, royalty-free license to:
- Store your data on our servers (Supabase)
- Process your data to provide App functionality
- Use anonymized, aggregated data for analytics and service improvement
- We will never sell your personal data to third parties
- You can export your data at any time (Premium feature) or request a copy by emailing us
7.2 Our Content
- All intellectual property rights in the App, including design, code, graphics, logos, and trademarks, belong to Mobile Craft
- These Terms do not grant you any rights to use our trademarks, brand names, or logos
- You may not copy, modify, distribute, sell, or lease any part of the App
- You may not extract source code or create derivative works from the App
8. Food Safety Disclaimer
8.1 Important Notice
Fresh Keeper is a tracking tool only. We are NOT responsible for food safety.
- The App provides expiry date notifications based on data YOU enter
- We do not verify the accuracy of expiry dates or product information
- Notifications are reminders only and should not replace your judgment
- Always check product packaging, appearance, smell, and taste before consuming
- We are not liable for any illness, injury, or harm resulting from:
- Consuming expired or spoiled products
- Relying solely on App notifications
- Incorrect expiry dates entered by you
- Missed notifications due to device settings, internet connectivity, or app issues
8.2 Your Responsibility
- You are solely responsible for determining whether food is safe to consume
- When in doubt, discard the product
- Follow proper food storage guidelines
- Consult official food safety resources and guidelines
9. Third-Party Services
Fresh Keeper integrates with the following third-party services:
9.1 Advertising
- Google AdMob: Displays advertisements in the free version of the App
- AdMob has its own Terms of Service: AdMob Terms
9.2 Analytics and Crash Reporting
- Firebase Analytics: Tracks app usage to improve user experience
- Firebase Crashlytics: Collects crash reports to fix bugs

9.3 Authentication and Cloud Functions
- Google Sign-In: Allows authentication using your Google account
- Firebase Cloud Messaging: Sends push notifications
- Firebase Cloud Functions: Powers backend functionality
9.4 Data Storage
- Supabase: Stores your account and inventory data securely

9.5 Payment Processing
- Razorpay: Processes all subscription payments securely

We are not responsible for the practices of these third-party services. Please review their terms and privacy policies.
10. Liability and Disclaimers
10.1 No Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement
- Warranties that the App will be uninterrupted, error-free, or virus-free
- Warranties regarding the accuracy, reliability, or completeness of any content
10.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Mobile Craft shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- This includes damages for loss of profits, data, goodwill, or other intangible losses
- Our total liability shall not exceed the amount you paid for Premium subscription in the 12 months preceding the claim
- For free users, our liability is limited to ₹100 (one hundred Indian Rupees)
10.3 Specific Disclaimers
We are NOT liable for:
- Food poisoning, illness, or injury from consuming expired or spoiled products
- Data loss due to device failure, internet connectivity issues, or user error
- Unauthorized access to your account due to your failure to secure your device
- Service interruptions due to maintenance, technical issues, or third-party service failures
- Financial losses from incorrect price tracking or wastage calculations
- Referral disputes or leaderboard inaccuracies
10.4 Indemnification
You agree to indemnify, defend, and hold harmless Mobile Craft, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit through the App
11. Termination and Suspension
11.1 Termination by You
- You may terminate your account at any time by:
- Contacting us at freshkeeperhelp@gmail.com
- Using the account deletion feature in the App (if available)
- Upon termination, your data will be deleted within 30 days as described in our Privacy Policy
- Active subscriptions will continue until the end of the billing period with no refunds
11.2 Termination by Us
We reserve the right to suspend or terminate your account immediately, without prior notice, if:
- You violate these Terms or our Privacy Policy
- You engage in referral fraud (creating fake accounts, using bots, etc.)
- You engage in abusive behavior or harassment
- You use the App for illegal purposes
- You attempt to hack, exploit, or disrupt the App or our systems
- You engage in payment fraud or chargeback abuse
- You share your account with multiple users
- We are required to do so by law
11.3 Effect of Termination
Upon termination:
- Your right to access and use the App immediately ceases
- We may delete your account data within 30 days
- You remain liable for any outstanding payments
- No refunds will be provided for prepaid subscription periods
- Sections of these Terms that should survive termination will remain in effect (e.g., liability limitations, indemnification)
11.4 Account Inactivity
- Accounts inactive for more than 24 months may be deleted without notice
- We will attempt to notify you via email before deleting inactive accounts
- You can prevent deletion by logging in periodically
12. Modifications to the App and Terms
12.1 App Updates
- We may update the App at any time to add features, fix bugs, or improve performance
- Updates may be required to continue using the App
- We do not guarantee that the App will always be compatible with your device or operating system
- You agree to accept updates when offered
12.2 Changes to Terms
- We may modify these Terms at any time
- We will notify you of material changes by:
- Posting the updated Terms in the App
- Sending an email notification
- Displaying a notice when you open the App
- Continued use of the App after changes constitutes acceptance of the new Terms
- If you do not agree to the changes, you must stop using the App and may terminate your account
12.3 Changes to Pricing
- We reserve the right to change subscription prices at any time
- Price changes will be communicated at least 30 days in advance
- Current subscribers will not be affected until their next renewal period
- You may cancel your subscription before renewal if you do not accept the new price
12.4 Service Discontinuation
- We reserve the right to discontinue the App at any time
- We will provide at least 30 days’ notice before shutting down the service
- Notice will be sent via email and in-app notification
- Upon discontinuation:
- You will have 30 days to export your data (Premium feature will be enabled for all users)
- All subscriptions will be cancelled with no refunds for unused time
- Your data will be permanently deleted 30 days after service discontinuation
13. Dispute Resolution and Governing Law
13.1 Governing Law
These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
13.2 Jurisdiction and Venue
Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts in Nagpur, Maharashtra, India. You consent to the personal jurisdiction of these courts.
Before filing a legal claim, you agree to first contact us at freshkeeperhelp@gmail.com to attempt to resolve the dispute informally. We will attempt to resolve disputes within 30 days of receiving your complaint.
13.4 Time Limitation
Any claim or dispute must be filed within one (1) year after the claim or cause of action arises, or it will be permanently barred.
13.5 Class Action Waiver
You agree to resolve disputes with us on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration.
14. General Provisions
14.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mobile Craft regarding the App.
14.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
14.3 Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
14.4 Assignment
You may not assign or transfer these Terms or your account without our written consent. We may assign our rights and obligations without restriction.
14.5 Force Majeure
We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to:
- Natural disasters, pandemics, or acts of God
- War, terrorism, or civil unrest
- Government actions or legal restrictions
- Internet or telecommunications failures
- Third-party service provider failures (Firebase, Supabase, Razorpay, AdMob)
14.6 Language
These Terms are provided in English. Any translations are for convenience only. In case of conflict, the English version prevails.
14.7 No Partnership
Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Mobile Craft.

- You are responsible for the accuracy of data you enter and for food safety decisions
